THIS
AGREEMENT, made and entered into this ____day of ______20__, by and
between Halo Ranch Outfitters and _____________________________________________________________________

hereafter referred to as Purchaser/Lessor.
1. Halo Ranch Outfitters will
provide horses and tack, specified in this agreement, for which
_______________________________________________________will pay Halo
Ranch Outfitters the sum as listed at the bottom of this
agreement from the:

of _______, 20___
2. The Purchaser/Lessor will provide suitable pasture
and supplementary feed to keep all of said horses in good useable condition
during the entire period of their possession and will stay with the horses until
picked up by, or returned to, Halo Ranch Outfitters. All equipment
will be returned in the same condition as received. Halo Ranch Outfitters reserves
the right to charge Lessor if repairs are necessary for damaged
equipment.
3. Purchaser/Lessor will become the owner of
the horse/horses and will receive a bill-of-sale at pick-up or
time of delivery. Separate checks of $10,000 for each horse will be collected by Halo
Ranch Outfitters.
If horse/horses are returned to Halo Ranch Outfitters by or before the
above-listed date, the $10,000 check will be returned to the Purchaser/Lessor and
likewise, the bill-of-sale will be returned to Halo Ranch Outfitters;
this transaction will then become a lease. By mutual cancellation agreement, the
check/checks will not be deposited unless the Purchaser/Lessor chooses to keep the horse/horses. Purchaser/Lessor
will bear any costs or treatments of horses which become sick or are injured.
If horses are returned with wither sores, rope burns, malnourished, or any
other damages deeming them to be temporarily unusable, Purchaser/Lessor agrees
to pay Halo Ranch Outfitters a $500.00 penalty charge. In the
event a horse becomes permanently injured so as to no longer be usable, the Purchaser/Lessor
will consequently continue ownership and Halo Ranch Outfitters will
accordingly deposit the $10,000 check.
4. The Lessor agrees to hold harmless, defend,
and indemnify Halo Ranch Outfitters against any claims for damage,
injury, injury resulting in any type of disability, injury resulting in death,
or death resulting from the use of any of the horses and /or equipment which
are the subject of this agreement. Lessor agrees to adhere to the
provisions of, or comparable to, Montana Statute 27-1-727 regarding liability
risk inherent in equine activity resulting from the risks inherent in equine
activities, pursuant to 27-1-727, MCA.
5. Choice of Law: This Agreement is adjudicated
and performed in Fremont County, ID. The District Court of this county
has sole jurisdiction over any dispute under this Agreement.
ADDITIONAL COST OPTIONS (Only if Applicable)
Option# 1. Halo Ranch Outfitters will _____or

and the full lease amount will be collected (in cash) when Purchaser/Lessor
obtains horse/horses. Without a check, a scanned lease agreement, by
email, will not fully ensure that horses and tack will be
available. The $10,000 per horse check is not included in the securities deposit but will be rendered when the Purchaser/Lessor accepts and takes over ownership of the horse/horses. |

At
the time of pickup, or delivery, the names
of horses and descriptions of tack (if applicable) will be listed on
the back of this agreement and photos will also be taken with the
Purchaser/Lessor
